1. About these Terms
These Terms govern your use of the Naild mobile application and related website pages that link to these Terms (together, the "Service"). Naild is operated by Kristóf Jakab, a private individual in Hungary ("Naild", "we", "us", or "our"). Contact: support@trynaild.com.
These Terms are a draft, are not legally approved, and are not yet effective. They will apply only after the final version and its effective date are published. Before using the Service, read these Terms together with our Privacy Policy and Community Guidelines.
2. The Service and its price
Naild provides nail inspiration, saved collections, search and discovery, and artist portfolio features. The Service is initially free. Naild does not currently offer subscriptions, paid artist accounts, in-app purchases, booking fees, commissions, payment processing, or paid services.
Artists may include links to third-party profiles or booking services. Naild does not arrange, provide, or process appointments or transactions made through those services. Any such transaction is between you and the third party or artist, and is governed by their terms and privacy practices.
3. Eligibility and accounts
You must be at least 18 years old to create or use a Naild account. You must provide accurate account information, keep your sign-in credentials secure, and promptly tell us if you suspect unauthorized use. You are responsible for activity carried out through your account, except where applicable law provides otherwise.
You may register using email and password, Google, or Apple where available. You may not impersonate another person, create an account using information you are not entitled to use, or evade a restriction by creating another account.
4. Client and artist accounts
Clients may browse inspiration, search, like designs, and organize saved collections. Artists may create a profile, publish portfolio entries, and include external links. You must use the features associated with your account role lawfully and keep information you publish accurate.
Naild does not verify every artist, portfolio, qualification, claim, image, or external link. A profile or design appearing in Naild is not a recommendation, endorsement, guarantee of quality, or confirmation that an artist is available.
Content may become visible immediately after you publish it. Naild does not routinely review submissions before publication. However, we may review reported content and take appropriate action if we determine that it violates our rules or applicable law. Publication does not constitute Naild's approval, verification, endorsement, or guarantee of the content, its creator, or any claim associated with it. Nothing in this section limits Naild's responsibilities or duties under applicable law.
5. Your content and permissions
You retain any rights you hold in the images, text, profile information, and other material you submit ("Your Content"). You are responsible for choosing, creating, and uploading Your Content and must have all rights, permissions, and lawful grounds needed to upload it, make it available to others, and grant the licence below. This includes permission for recognizable people shown in images where required by law. You must not upload content that infringes another person's rights or misrepresents another person's work. These responsibilities do not transfer or remove any responsibility Naild has under applicable law.
You grant Naild a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, adapt for technical display, and display Your Content within the Service, and to provide it to our service providers solely as needed to operate, secure, and support the Service. The licence lasts while Your Content is available through the Service and for any limited period needed to complete removal from backups or comply with law. We do not acquire ownership of Your Content under this licence.
Published artist profiles and portfolio entries may be visible to other users. Do not upload confidential information or content you do not want displayed in that context. You can remove content using available app features or request assistance at support@trynaild.com.
6. Rules for using Naild
You must follow the Community Guidelines. In particular, do not:
- Upload content that infringes copyright, privacy, publicity, or other rights.
- Impersonate a person, misrepresent your identity or work, or publish misleading claims.
- Post unlawful, hateful, threatening, harassing, sexually exploitative, or otherwise abusive material.
- Use Naild to scam, spam, deceive, or harm people, or to distribute malicious links.
- Interfere with the Service, bypass access controls, or use another person’s account without permission.
7. Reports, moderation, and intellectual-property complaints
You can report an artist profile or portfolio entry using the in-app Report action. You can block an artist using the in-app Block action. If you cannot use those controls, contact support@trynaild.com. Please identify the account or content and explain the concern; do not send passwords or authentication codes.
We may review reports and other information that comes to our attention. We may hide or remove content, limit features, or restrict, suspend, or terminate an account where we reasonably consider it necessary to enforce these Terms or the Guidelines, protect people or the Service, or comply with law. We may dismiss reports that do not establish a violation. Where required by applicable law, we will provide a statement of reasons for moderation decisions. You can request another review by emailing support@trynaild.com with the decision and relevant account or content details. There is no in-app appeal feature at present; any deadlines or procedures required by applicable law continue to apply. These Terms do not require manual review or approval of each upload before publication. Moderation is reactive; where content is made available on submission, that publication is not Naild's approval, verification, endorsement, or guarantee.
To report content you believe is illegal, use the in-app Report action where available or email support@trynaild.com. Identify the specific content (for example, with its profile or content link), explain why you consider it illegal, and provide relevant supporting information and contact details. We will handle notices and moderation decisions as required by applicable law. Where the law requires reasons or a complaint or review procedure, nothing in these Terms excludes or limits those requirements or any rights available to you.
If you believe content hosted in Naild infringes your intellectual property, email support@trynaild.com with the content location, a description of the right and work concerned, your contact details, and the reason you believe the use is unauthorized. We may request further information and take action as appropriate. Do not knowingly submit false or misleading complaints.
8. Availability and changes
We may add, change, pause, or discontinue features for operational, safety, or legal reasons. We will not exclude rights you have under mandatory law. We do not promise that the Service or user content will always be available, uninterrupted, complete, or accurate.
9. Account closure and termination
You may request account deletion through the app settings or contact support@trynaild.com if you cannot use the in-app process. Details are in our Account Deletion information. We may suspend or terminate access for a serious or repeated breach, a legal requirement, or a necessary safety or security reason, subject to applicable law. Where appropriate, we will consider the nature and seriousness of the issue and any applicable rights to receive reasons or seek review.
10. Liability and mandatory rights
Nothing in these Terms removes or limits any liability, remedy, or consumer right that cannot lawfully be removed or limited. In particular, these Terms do not exclude liability to the extent exclusion is prohibited by applicable law.
To the extent permitted by applicable law, we are not responsible for independent third-party services, external links, or content and transactions provided by other users or third parties. This does not affect any responsibility we have under mandatory law.
11. Applicable law and disputes
These Terms are governed by Hungarian law, without depriving consumers of protections that apply to them under mandatory laws. Any court or dispute-resolution rights available under mandatory consumer law remain unaffected.
12. Changes to these Terms and contact
We may update these Terms as the Service or applicable law changes. We will publish the updated text and effective date. If a change materially affects users, we will provide notice or request renewed acceptance where required by law.
